The Agriculture Improvement Act of 2018, more commonly known as the Federal Farm Bill, brought about two major changes in how we legally define cannabis.
First, it distinguished hemp from marijuana as follows:
- Hemp is cannabis containing less than 0.3% Delta-9 THC by dry weight.
- Marijuana is cannabis containing more than 0.3% Delta-9 THC by dry weight.
Second, while marijuana, as defined above, is still considered a controlled substance, hemp was removed from the list of federally controlled substances.
These changes mean that products that meet the Farm Bill's Delta-9 content limits of less than 0.3% by dry weight, such as Mood's hemp-derived cannabis products, are now federally legal and available in many states.
